If you are a Washington resident and a former tenant of a rental property in Washington State and IQ Data International, Inc. collected or attempted to collect interest that was calculated from your moveout date you may be entitled to benefits from a class action Settlement.

This is not a solicitation from a lawyer, and it is not a lawsuit against you. This is not an attempt to collect a debt.


  • IQ Data has agreed to establish a fund valued at $4,000,000 from which eligible persons will receive cash awards. The fund will also be used to pay Court-ordered settlement administration expenses, statutory damages, service awards, and attorneys’ fees and costs. Then, $225,000 of the fund will be allocated to the FDCPA Class and the rest of the fund will be allocated to the CPA Class. If you are a member of the FDCPA Class, you must submit a claim to get a payment. If you are a member of the CPA Class, you will get a payment as long as the Class Administrator has your correct address.
  • The Settlement resolves a lawsuit over whether Defendant IQ Data International, Inc. violated the federal Fair Debt Collection Practices Act (“FDCPA”), Washington Collection Agency Act (“WCAA”), and Washington Consumer Protection Act in its attempts to collect alleged debts by adding interest to former tenant accounts calculated from the date the tenant moved out, when the alleged debts were alleged to be unliquidated, and not subject to prejudgment interest.
  • IQ Data does not admit to any wrongdoing and denies the allegations in Plaintiffs’ complaint and amended complaint.  IQ Data further denies that the case should proceed as a class action. 
  • The Court presiding over the case issued an order approving Notice of the Settlement to the Classes and will decide whether the proposed Settlement should be approved.
  • Court-appointed lawyers for the Classes (“Class Counsel”) will ask the Court for an attorneys’ fee payment of $1,000,000 and $47,057 in litigation expenses from the Settlement Fund.
  • The two sides disagree on whether Plaintiffs and the Classes would have won at trial.
  • If you are a member of the CPA Class and you received a Notice, you will receive a payment. If you are a member of the FDCPA Class, you must file a claim by February 5, 2024 in order to receive a payment. Your estimated payment is listed on your postcard Notice but the amount included is only an estimate. The final amount may be different. Your legal rights are affected whether you act or not. FDCPA Class Members:

File a Claim by

To get a share of the $225,000 from the Settlement Fund allocated to the FDCPA Class, you must submit a claim.

If you are a member of the FDCPA Class, to get a cash payment, you must submit a claim form. You may submit a claim form online here. You may also mail the postage-paid tear off claim form attached to your postcard Notice.  Your claim form must be postmarked or received online by February 5, 2024. You may only submit one claim form. You may select electronic payment. If you shared an apartment with other adults, your Settlement Award amount will be split evenly among the tenants listed on the account. For example, if you lived with one roommate, you and your roommate will each receive half of the Settlement Award associated with your account.  If you have any further questions or need to change your address, please visit the Contact Us page. 

FDCPA Class Members:

Do Nothing

Stay in this lawsuit. Get no Settlement benefits. Give up certain rights.

By doing nothing, you give up any rights to sue IQ Date separately about the same or similar legal claims made in this lawsuit.

CPA Class Members:

By doing nothing, CPA Class Members keep the possibility of getting money or benefits that come from the Settlement, but you give up any rights to sue IQ Data separately about the same or similar legal claims made in this lawsuit. Exclude yourself by February 5, 2024.

Get out of this lawsuit. Get no benefits from it. Keep rights to sue.

If you exclude yourself, you will not be eligible to receive any money or benefits that come from the Settlement and you may not object. This is the only option that allows you to be part of any other lawsuit against IQ Data about the legal claims in this case.

Object by February 5, 2024.

Stay in this lawsuit. File with the Court a written objection to the Settlement. 

If you disagree with any portion of the Settlement Agreement, you may file a written objection with the Court, which will be considered at the Final Approval Hearing. If you file an objection, you may not exclude yourself from the Settlement. If the Settlement is approved, you will be bound by the Settlement Agreement and you give up the rights to sue IQ Data separately about the same or similar legal claims in this lawsuit, but you will still be eligible to receive money and benefits that come from the Settlement if you are a CPA Class Member or you are an FDCPA Class Member and you submit a valid claim.

Attend a hearing on March 1, 2024 at 8:30 AM PT.

If you do not exclude yourself, you may ask to speak to the Court about the fairness of the Settlement.
